Research by Joan West (Note. The two leases below of 1975 and 1962 were made with Dick and Hilda West to acquire extra land for tennis courts. All stipuations were made to be idential to the lease made with Mrs Bateman when she leased the sports ground to the Sports Club, which was officially opened in July 1949)

Sports Club Lease

THIS LEASE made the day of 1975 BETWEEN RICHARD MONTAGUE WEST and HILDA ELSIE WEST both of New Bungalow Lacey Green Aylesbury in the County of Buckingham formerly of Stocken Farm Lacey Green aforesaid (hereinafter called “the Lanclords” which expression shall where the context so admits include the person for the time being entitled to the reversion immediately expectant on the term hereby created) of the one part on ans WILLIAM FREDERICK CECIL DELL of Ashleigh Lacey Green aforesaid IVOR WILLIAM KELLOWAY of The Haven Lacey Green aforesaid GEOFFREY ROBERT TURNER BATEMAN of Grymsdyke Lacey green aforesaid and EDWIN LEONARD BIGGS of High Peaks Little Kimble Aylesbury aforesaid Trustees of Lacey Green and Loosley Row Sports Club (hereinafter called respectively "the “Trustees and the Club" the expression the ‘Trustees including the Trustees for the time being of the Club) of the other part

WITNESSED as follows:

1. in consideration of, the rent and the covenants by the Trustees hereinefter reserved and contained the Landlords hereby demise to the Trustees ALL THAT piece of land situate in the Parish of Lacey Green (formerly-Parish of Princes Risborough) in the said County of Buckingham being part No.126 on the Ordnance Survey Map for the said Parish (1921 Edition) having a frontage to a road there leading from Lacey Green to Speen of thirty feet a width at the rear of sixty-six feet and a depth from the said road of five hundred feet or there-abouts. All which said piece of land is for the purpose of identification only more particularly delineated on the plan annexed hereto and thereon edged red TO HOLD the same unto the Trustess for the term of ninety-nine years from the day of 19

PAYING therefor during the tenancy the yearly rent of One pepercorn on the first day of each year

2. The Trustees shall stand possessed of the said premises upon trust to use or permit the same to be used as a Sports Ground by the inhabitants of the villages of Lacey Green aforesaid and the adjoining village of Loosley Row and shall have no power to mortgage charge or otherwise dispose of the premises

3. The Trustees for themselves and the survivors and survivor of them hereby covenant with the Landlords to perform the provisions and stipulations in the Schedule hereto

4. The Landlords hereby covenant with the Trustees that the Trustees observing and performing the provisions and stipulations contained in the Schedule hereto shall peaceably hold and enjoy the demised premises during the said term without any interruption by the Landlords or any person rightfully claiming under or in trust for them

5. PROVIDED ALWAYS AND IT IS HEREBY AGREED as follows that if there shall be a breach of any stipulation or provision contained in the Schedule hereto or if the premises shall cease for the period of six months to be used as a Sports Ground for the inhabitants aforesaid then the Landlords may re~enier on the demised premises and thereupon the term created shall forthwith determine without prejudice to the Landlords rights and remedies in respect of any such breach

IN WITNESS whereof the parties hereto have hereunto set their hands and seals the day and year first before written

THE SCHEDULE above referred to

Obligations of the Trustees

1. To discharge all existing and future rates taxes assessment and outgoings whatsoever imposed on or payable by the owner or occupier of the demised premises in respect thereof

2. To keep all the hedges fences and gates upon the demised premises always in good repair and condition and the gates always locked when the demised premises are not in actual use

3. To make such arrangements and no others in the character and general arrangement of the demised premises as may be necessary or desireble for laying out and maintaining the same as a Sports Ground

4. Not to assign mortgage or charge the demised premises or underlet the same or any part thereof without the previous written consent of the Landlords

5. Not without the Landlord's previous written consent to cut down or injure any trees plants bushes or hedges or remove any soil clay sand or other materials from the demised premises

6, Not to erect any building or other structure on the premises except such pavilion dressing rooms end sheds as shall be aproved by the Landlords or her Surveyor

7, To use the demised premises and such buildings (if any) as may be erected thereon pursuant to Clause 6 hereof as a Sports Ground for the recreation of inhabitants of the village of Lacey Green and Loosley Row aforesaid or for such other games or recreationsas may be sanctioned or approved from time to time in writing by the Landlords

8. To permit the Landlords and their agents at all reasonable times to enter the demised premises to inspect the condition thereor and for all other reasonable purposes

9. Will not do or omit or suffer to be done or omitted any acts matter or thing in on or respecting the demnised premises required to be omitted or done by the Town and Country Planning Act 1947 or the Local. Planning Authority or which shall contravene the provisions of the said Act or any direction or redirectment of the Local Authority and will at all times hereafter indemnify and keep indemnified the Landlords against all actions claims and demands in respect of any such matter or thing contravening the said provisions of the said Act or directions or requiements of the Local Planning Autnority or any of them and will also not commit wilful or voluntary waste spoil or destruction in or upon the said premises

10. To deliver up the demised premises at the termination of the term in a condition consistent with the foregoing provisions

1962 Lease for Extra Land to enable a tennis court to be built in the southeast corner of the Sports Club grounds.

Lease between Richard Montague West and Hilda Elsie West both of Stocken Farm Lacey Green in the County of Buckingham, "the landlords", of the one part and Edwin Leonard Biggs of "Wayside Cottage", Lacey Green and Herbert Steven Tong of "Woodfield Cottage", Lacey Green "the Trustees"

Schedule. The Landlords leased to the Trustees - All that piece of land situate at Lacey Green having a frontage of 15 feet against Slad Lane and a depth therefrom of 140 feet (upon which to build a tennis court) to hold for the term of 86 years from the 1st January 1962 for the yearly rent of one peppercorn on the first day of each year.

The Trustees shall stand possessed of the said premises upon trust to use or permit the same to be used as part of the sports ground or tennis courts by the inhabitants of the Villages of Lacey Green and the adjoining Village of Loosley Row.

Provided Always and it is hereby agreed as follows :-

If there shall be a breach of any stipulation or Provision in the Schedule or if the premises shall cease for a period of six months to be used as a sports ground or tennis courts for the inhabitants aforesaid then the Landlords may re-enter the premises without prejudice.

The Provisions and Stipulations. The obligations on the part of the Trustees

  1. To discharge all existing and future Rates, Taxes, Assessments and outgoings whatsoever imposed on or payable by the owner or occupier of the demised premises in respect thereof.
  2. To erect and maintain Twelve feet high chain link fencing around any tennis court on the sides of the court adjacent to the boundaries marked "T" on the plan.
  3. To erect and maintain good and substantial cattle proof fences on the sides of the boundary marked "T" within the boundary on the said plan.
  4. Not to assign, mortgage or assign the premises or underlet any part thereof without the previous written consent of the Landlords.
  5. Not without the Landlords previous written consent excavate or remove any soil, clay, sand or other materials from the premises.
  6. Not to erect any building or other structure on the remises unless the same shall have been approved in writing by the Landlords.
  7. To permit the Landlords or their Agents at all reasonable times to enter the premises to inspect the condition thereof and for all other reasonable purposes.
  8. To deliver up the premises at the termination of the term in a condition consistent with the foregoing provisions.

December 1972 A request by E. Biggs, secretary of the Sports Club, was made to Dick and John West of Stocken Farm for a further piece of land to extend the sports field, to be 15 feet wide joining to the tennis court and stretching in a northwards direction for 72 yards. A second tennis court and a bowling green were proposed.

April 1974. Dick West wrote agreeing to the request. The Chairman then being W.F.C Dell. click Bill & Phyllis Dell. It took until July 1975 for the Lease to be drawn up.

July 1975 Lease given by Richard Montague West and Hilda Elsie West of Stocken Farm, Lacey Green to the trustees of The Sports Club, then being William Frederick Cecil Dell (click Bill & Phyllis Dell) of Ashleigh Lacey Green, Ivor William Kelloway of The Haven (click Ivor & Joan Kelloway) Lacey Green, Geoffrey Robert Turner Bateman of Grymsdyke (click Robert & Paddy Bateman) Lacey Green and Edwin Leonard Biggs of High Peaks, Little Kimble (click Ted & Audrey Biggs)

Schedule

The landlords leased to the Trustees of the Sports Club:-- All that piece of land situate in the Parish of Lacey Green being part No.126 on the Ordinance Survey Map (1921 Edition) having a frontage to Slad Lane of 30 feet, a width of at the rear of 66 feet and a depth from the said road of five hundred or thereabouts. All which said piece of land is for the purpose of identification only delineated on the plan annexed hereto and thereon edged red to hold the same for ninety- nine years, paying the yearly rent of one peppercorn on the first day of each year.

The Trustees shall stand possessed of the said premises upon trust to use or permit the same to be used as part of the sports ground or tennis courts by the inhabitants of the Villages of Lacey Green and the adjoining Village of Loosley Row.
