Indenture dated 17th November 1605 – Princess Queene Anne (the wife of King James I) and Sir Jerome Horsey
THIS INDENTURE made the seaventeenth day of November in the years of the raigne of our Soveraigne Lord James by the grace of God of England Scotland France and Ireland King defender of the fayth ? that is to saye of England France and Ireland the eighty and of Scotland the fourer and fortiey BETWEENE the most high and excellent Princess Anne by the like grace of ? England Scotland France and Ireland Queene on the one parte and Sir Jerome Horsey of Kymball in the County of Buck knight on the other parte WITNESSETH that whereas the late Queene of famous memorie Queene Elizabeth by her highenes Letters Patente under the great seale of England bearing date att Westmynster the eight and adventieth daye of January in the season and thirtieth yeare of her late Highenes ? for the consideracon therein expressed and amongst other things give grant demyse and to tearme lett unto one Henry Best of London Scrivener all that wood and underwood and all that woodground called or known by the name or names of Stockins conteyning by estimacon threescore acres bee it more or lesse lyeing and being within the Mannor of Risborough principis in the County of Buck excepted and always reserved unto the said late Queene her heires and successors all and manner of great trees with ? tymber or reputed for tymber and all trees and fayre sapplings of ? apte and fit to be or bee made tymber and sufficient staddles in everie acre of the premises according to the terme of the statute in that case lately lett forth and provided TO HAVE AND TO HOLD the aforesaid wood called Stockins with all and singular appurtenence whatsoever (except before excepted) unto him the said Henry Best his executors and assignes from the feaste of Amunicacon of the blessed Lady Mary the virgine with then and should bee in the yeare in the yeare of our Lord God one thousand six hundred and five unto the ende and terme and for the tearme of thirtie years next ensuing and full to bee compleate and ended YEILDING AND PAYEING therefore yearlie unto the said the said late Queene her heires and successors the some three pounds fourerteene shillings eight pence of lawfull money of England all by feastes of Saint Michael the Archangell and the Amunnicacon of the blessed Lady Mary the virgin by eaven and equall porcons to be paide during the said terme as in and by the said recited letters ? more att large appeareth NOWE these presente soe witnesse that the said most excellent Princess Queene Anne of her social grace certanie knowledge and mere mocon and for and in consideration of the some of tenn poundes of lawfull momey of England before the ensealing hereof paide unto the Right Honorable the Lord ? her Majesties Vice Chamberlaine and Receyver genall to the use of her said Majestie therof and of any parte and parcel thereof her said Majestie doth by these presente acknowledge her selfe fully satisfied contented and paide HATH by verture of the ? and antiquity of granting and making of leases in revertion given unto her by Acte of Parliament by the advice of Councill given and granted demised and to terme letter and by these presente doth gyve grant demyse and to terme lett unto the said Sir Jerome Horsey knight his executors and assignes all those the said woods and underwoods and all those the said woody groundes called or knowen by the name or names of Stockings contayning by estimacon three score acres bee it more or lesse lying growing and being within the said Mannor of Risborough principis in the said County of Buck excepted always reserved un to the said most excellent Princess Queene Anne and her assignes during her natural life and after her decease unto the Kinge Majestie his heires and successors all and all ? of greate trees are tymber reputed for tymber and all trees and fayre saplings of ? apte and fit to be made tymber and sufficient staddles in every acre of the premises according to the Terme of Statute in that case lately lett forth and provided TO HAVE & TO HOLDE the aforesaid woods called Stockinge with all and singular whatsoever (except before excepted) unto the said Jerome Horsey his executors and assignes from and after the ende expiracon surender of after determynacon whatsoever of the estate lymytted by the the aforesaid recited l’res patente unto the ende and terme and for and during the whole terme of twenty and one years from thence next ensuing and fully to be compleete and ended YEILDING & PAYEING therefore yearlie unto the said most excellent Princess Queene Anne and her assignes during her natural life and after her decease unto the King Majestie his heires and successors the some of three pounds fourerteene shillings eight pence of lawfull money of England at the two most usual feastes or termes in the yeare that is to saye att the feast of Saint Michael and Amunicacon of the blessed Lady Mary the virgine by even and equall porcons to be paide during the said terme the first payment thereof to be made att first of the said feastes that shall first come next after the ende and determinacon of the estate ? by the aforesaid recited l’res patente and the said rent to be paide during her said Majesties lyfe unto her Majesties Receyver of the said County of Buck for the tyme being and after her ? decease the Receyver of the Kinge Majesties heires and successors of the said County of Buck for the tyme being AND the said Sir Jerome Horsey hath for himself his executors administrators and assignes comite promise and grant by these presente to and with the said most excellent Princess Queene Anne and her assignes during her natural life and after her decease to and with the Kinge Majestie his heires and successors that neither bee the said Sir Jerome Horsey his executors ? or assignes now and after being comite or recyver of the p’mised will doe or willingly or willingly suffer to bee ? any manner of ? in and upon the afore demyse p’misses or any parte thereof during the said terme by these present demised AND the said Sir Jerome Horsey doth further for himself his executors and assignes comite promise and grant by these p’sente to and with the said most excellent Princess Queene Anne and her assignes that within one whole yeare next ensuing the date yeare of for they will envolve or cause to be envolved his present lease and demyse before her Majesties Auditor of the said County od Buckingham for the tyme being AND LASTLYE the said Sir Jerome Horsey doth for himself hie executors administrators and assignes hereunto p’mise and grant by these p’sente and with the said most excellent Princess Queen Anne and her assignes her naturall lifeand after her decease to and with the King Majestie his heaires and successors that is and as often as it shall happen the aforesaid yearlie rent above by these p’sente reserved to be behind and unpaid in parte or in all by the soace of forty dayes after any feaste or days of the aforesaid feasts wherein the said rent ought to be paide that then and for evrye such defaults of payment by the soace of fortydayes next after any of the said feastes or days such shall happen during the natural life of the said most excellent Princess Queene Anne the said Sir Jerome Horsey his executors administrators and assignes shall paye and forfeyte unto the said most excellent Princess Queene Anne and her assignes the some of twenty shillings of lawfull English money and for ev’ry default of payment of the said rent by the space of forty days next after the days or feastes in which it ought to be paide which shall happen after her Majesties decease some of twenty shillings nomme pene to his Majestie his heires and successors and that then and from thence forth from tyme to tyme so often as the case so happen it shall and maye bee lawfull to and for the said most excellent Princess Queene Anne and her assignes by her Recyvor of the said County of Buckingham for the tyme being by her Bayliffe of the p’misses there for the tyme being or theire sufficient deputies during her naturall life and after her decease to and for the Kinge Majestie his heires and successors by his or their Recyvor genall of the said County of Buck for the tyme being or by his or their Bayliffe of the p’misses there for the tyme being of their sufficient deputies into the aforesaid p’misses or into and parte or parcel of them to enter and distress and the distressed there found or to be found to take and retayne until the said most excellent Princess Queene Anne or her assignes during her natural life and after her decease until the Kinge Majestie his heires successors shall of the aforesaid rent and some of money togeather with ? and forfeytures in the nomme pene aforesaid be fully satisfied contented and paide any ? in the ? contained to the contrary in anywise not with standing in WITNESSE thereof to the one parte of these p’sente the said most excellent Princess Queene Anne hath caused her greate seale to be putt and to the other parte there of the said Sior Jerome Horsey hath putt his name and seale the daye and yeare above written
This contayneth a lease for thirtie years in revertion from her Majestie unto Sir Jerome Horsey knight of one wood with the appurtenences called Stocking being parcel of her Majesties Mannor of Risboroughe principis in the County of Buck reserving therefore the ? yearely Rent of three pounds fournteen shillings eight pence and for the fyne of ten pounds.
