Indenture dated 9th November 1629 – Sir Robert Dormer and William Wydmer

This indenture made the nynth day of November anno domini and in the raigne of our soveraigne Lord Charles by the grant of God King of England  Scotland France and Ireland defender of the faith ? Between Sir Robert Dormer of Dorton in the county of Bucks knight of the one parte and William Wydmer of the parish of Cheping Wycombe in the said County of Bucks gent of the other parte WHEREAS our late soveraigne Lady Queene Elizabeth by her highnes l’res patente under the the great seale of England bearing date at ? the eight and twentieth daye of January in the seaven and thirthyeth yeare of her late Highnes reigne for the consideracon therein expressed did (amongst other things) giv grannt and to farme lett unto one Henry Best of London scrivener All that wood and underwood And all that woodground called or knowne by the name or names of Stockings conteyning by estimacon three score acres were it more or less lying growing and being within the Mannor of Princes Risborough in the said county of Bucks and being p’cell of the same Mannor and p’cell of the possessions assigned to the said late Queene Elizabeth before her coming to the Crown of England and demised and grannted to one Robert Sandy by her highness l’ers patent sealed with the seale of her then highness court of exchequer bearing date the forertenth day of July in the six and twentieth yeare of her Ma’ies reigne for the terme of twenty and one yeres begyning from the feast of  Th’annuciacon the blessed virgin Mary then last past under the yerelie rent of seaventy forer shillings and eight pence (except and unto the said late Queene Elizabeth) her heires and successors always reserved All and all manner of great trees with then newe timber or reputed for timber And all trees and all faire sapplings of date fit to be or make timber and all sufficient Staddles in any acre of the p’misses according to the forme of the statute in like case made and p’vided TO HAVE and to hold the afore said wood underwood and all the aforesaid woodland and all and singular other the p’misses with the app’tennces (except before excepted) unto the said Henry Best his executors and assignes from the feast of the Th’annuciacon of the Blessed virgin Mary in the yere of our Lord God one thousand six hundred and six unto the end of terme of thirty and one yeares from there next ensuing and fully to be compleat ? therefore yerelie  unto the said late Queene Elizabeth her heires and successors for the p’misses seaventy forer shillings and eight pence of lawfull money of England at the feast of St Michaell Th’archangel and Th’annuciacon  of our Lady Mary the virgin at the receipt of the exchequer  of the said late Queene Elizabeth her heires and successors or to the hands of Bayliffs or ? of the p’misses for the time being by equal porcons all in and by the said l’res patent more at large appearete WHICH estate right title interest and terme of yeres then to com of the said Henry Best and all other the estate and interest of the said Henry Best in and to the said wood underwood and woodland sit hence by good and sufficient conveyance and assurance in the lawe come unto Sir Jerome Horsey late of Kimble in the County of Bucks knight as by the said conveyance thereof made more at large appearete AND whereas also the late highnes excellent Princess Anne late Queene of England by her highness indenture under her Majs great seale bearing date the seavententh day of November in the eight yeres of the reigne of our late Sovraigne Lord King James of England ? for the consideracon therein expressed by virtue and authie of granting and making of seales given unto her by Act of Parliament by the advise of her councell did give grante demise and to farme lett unto the said Sir Jerome Horsey his executors and assignes All those the afore said woods underwoods and woodgrounds an all other p’misses whatsoever except and alwais reserved unto the late Queene Anne and her assignes during her life and after her death unto the Kings Ma’ies heires and successors All and all manner of great trees with newe timber or reputed for timber and all faire sapplings ? ? and fit to be made timber and sufficient Staddells in every acre of the p’misses according to the forme of the statute in that behalf made and provided  TO HAVE and to hold the aforesaid woods and underwoods woodgrounds and all and singuler other the p’misses with app’tennces(except before excepted) unto the said Sir Jerome Horsey his executors and assignes from and after the end and expiracon surrender or other determinacon of the estate limitted by the said last recited l’res patents unto the end and terme and for and during the terme of twenty and one years from thence next ensuing and truly to be compleat and ended By and under the yerelie rent of three pounds forertene shillings and eight pence of currant money of England at the feast of St Michaell Tharchangell and Thannunciacon of our blessed Lady St Mary the virgin by even and equall porcons also in and by the said indenture it doth and may more fully appeare ALL with several estates interests and termes of the said Sir Jerome Horsey are ? by good and sufficient conveyance and assurance in the lawe comen unto Sir John Dormer late of Dourton afore said knight ? with time the said Sir John Dormer is dead and hath made his last will and testament in writing and therof hath made and constituted the said Sir Robert Dormer his executors as in and by the said last will and testament relacon being there unto had more at large appeareth HAVE this indenture WITNESSNETH that the said Sir Robert Dorman for and in consideracon of the summe five hundred and forty pounds of good and lawfull money of England to him the said Sir Robert Dormer by the said William Wydmer beforehand well and trulye satissfyed contented and paid whereof and wherewith the said Sir Rober Dormer doth acknowledge himself fully satisfied contented and paid and thereof and and of every part and p’cell thereof doth thereby acquite exonerate and discharge the said William Wydmer his executors administrators and assignes and every of them foreber by their p’nts HATH granted bargained sold assigned and lett  by their p’nts Doth grante bargaine sell assigne and lett over unto the said William Wydmer his executors administrators and assignes all those the said woods underwoods and woodgrounds called or knowne by the name or names of Stocking And also all the estate and estates right title interest and interests terme and termes of yeres yet to come claime and demande whatsoever of him the said Sir Robert Dormer of in and to the said woods underwoods and woodgrounds and in and to every parte and p’cell thereof togithor with the letters patents and all the said indentures and all other indentures deeds evidences and writing touching or concerning the same premisses or any parte thereof (except as in the said l’res patents and in the said indenture made by the said late Queene Anne are excepted) TO HAVE AND TO HOLDE the said woods underwoods and woodgrounds and all and ?other the p’misses with their app’tences and all the estate and estates right title interest terme and termes of yeres claime and domannde whatsoever of him the said Sir Robert Dormer of in and to the same and every parte and p’cell thereof except as in the said  l’res patent and in the said indenture of lease made by the said late Queene Anne ? excepted unto the said William Wydmer his executors aministrators and assignes for and during all the residue of the said several termes and nombers of one and thirty yeares and twentye and one yeres nowe to come and unexpired in as large ample and beneficiall manner and forme to all intents construccous and purposed as he the said Sir Robert Dormer nowe hath and holdeth or of right ought to have holde and enjoy the same by virtue of the said ? l’res patents  indentures and conveyance or otherwise howsoever AND the said Sir Robert Dormer for himself his executors and administrators and for every of them doth comemite promise and grante to and with the said William Wydmer his executors administrators and assignes and to and with every of them by their p’nts That he the said William Wydmer his executors administrators and assignes under the Rents reservacons  and comemits in the said l’res patents and in the said indenture of lease made by the said late Queene Anne conteyned shall or may quietly and peaceably have hold occupy possesse and enjoy all the said wood underwood and woodground and all and ? other the prim’sses with their app’tenes and every part and p’cell thereof (except before excepted) for and during all the residue and soe much of the said several termes and nombers of one and thirty yeares and one and twenty yeares as are ? expired in the said l’res patents made by the said Queene Elizabeth and in the said indenture of lease made by the said late Queene Anne or in either of them without the lawfull lett trouble molestacon vexacon eviccon ? denial disturbance expulsion of the said Sir Robert Dormer executors administrators and assignes of John Dormer Squire sonne heire apparent of the said Sir Robert Dormer or of any other p’son lawfully clayming or to claime by from or under them or either or any of them IN WITNES whereof the parties above named to their p’sent indentures their hands and seales interchangably have ? Notes added by Laurence Rostron

  1. This indenture is complicated by earlier leases and rentals.
  2. However, the purpose of the indenture (agreement) is for William Wydmer to buy the lease (in modern terms) from Sir Robert Dormer for woods called Stockings for £540.00
  3. There appears to be some historical complication on the length of the lease between 21 and 31 years,
  4. The size of the woods is 60 acres.
  5. Stockings – the name of many woods and is relative to tree density. It is believed that the Parish of Princes Risborough had several Stockings woods but if this one refers to Lacey Green is unclear.
  6. The transcription contains many strange spellings – too many to list – but most can be understood when read in context.
  7. There are also a number of words that I cannot decipher.
