Indenture dated 25th February 1616 – Sir Jerome Horsey and Edward Thomasson

THIS INDENTURE MADE the five and twenty days of Februarie in the yeres of then reigne of our Soveraigne Lord James by the grace of god King of England Scotland France and Ireland defender of the faith and that is to saye of England France and Ireland the fourtieth and Scotland the fiftheth betweene Sir Jerome Horsey of Kimball in the county of Bucks knight on the one p’te and Edward Thomasson of London on the other p’te  WITNESSESS that whereas our late Sovraigne Lady Queene Elizabeth by her highnes l’res pattent under the great seale of England bearinge date at ? the eight and twentith day of Januarye in the seaven and thirtith yere of her late highnes reigne for the consideracons therein expressed and (among other things)give grant and demise and to terme lett unto Henry Best of London Scrivener all that wood and underwood and all those woodgrounds called or known by the name of Stockings conteyning by estimacon threescore acres be yt more or lesse lying growing and being within the Mannor of Princes Risborough in the said countie of Bucks and being p’cell of the same Mannor and p’cell of the possessions assigned to the said late Queene Elizabeth before her cominge to the crowne of England and demised and granted to one Robt Sands by her hignes l’res pattents sealed with the seale of the then highnes Court of Exchequer bearinge date the fourtenth day of July in the six and twentith yere of majesties reigne for the term of twenty and one yeres begyning from the feast of th’anuciacon of the blessed virgin Mary then last past under the yerely rent of seaventy foure shillings and eight pence EXCEPT and to the said late sovraigne Lady Queene Elizabeth her heires and successors alwayth reserved all and all manner of great trees with their newe tymber or reputed for tymber and all trees and all fayre saplings of or fit to be or make tymber and also sufficient staddels menie acre of the premisses and accordinge to the forme of the statute in the like case made and provided TO HAVE and to hold the aforesaid woods underwoods and all the aforesaid woodlands called or knowne by the name or names of Stockings conteyning by estimacon threescore acres more or lesse lying or growing and being within the said Mannor of Princes Risborough aforesaid p’cell of the same Mannor and their app’tennces whatsoever in the aforesaid county of Bucks (except before excepted) unto the afore said Henry Best his executors and assignes from the feast of th’anuciacon of the blessed virgin mary in the yere of our Lord God one thousand six hundred and five unto the end of the terme and by the terme of thirty one yeres from thence next ensuring and fullie to be complete YEALDINGE therefore then and from thensforth gentlie unto the said late Queene Elizabeth her heires and successors of and for the said woods and underwoods and the aforesaid woodlands p’cell of the said Mannor of Princes Risborough aforesaid twentyfoure shillings and eight pence of lawfull money of England at the feast of St Michael th’archall and the blessed virgin Mary all the receipt of the exchequer of the said late Queene Elizabeth her heires successors or to the hands of the bayliffs or ? of the said p’misses for the tyme being by equal porcons to be paid during the terme aforesaid by the said first recited l’res pattents granted as in and by the said l’res pattents to the said Henry Best made and granted as aforesaid more at large yt doth and may appeare WHICHE the state right title interest terme of yeres to come possession clayme and demand and demand of the aforesaid Henry Best of in and to the said woods underwoods and woodlands are by lawfull meanes and conveyance in lawe come to the aforesaid Sir Jerome Horsey knight AND WHEREAS also the most highe and excellent Princess Anne of England Scotland France and Ireland by her highnes Indenture under her Ma’es seale bearinge date the seavententh day of November in the yeres of the reigne of our said Sovraigne Lord King James of England Scotland France and Ireland and that is to saye of England France and Ireland the eight and of Scotland the foure and fourty for the consideracons therein expressed by virtue of the power and authortye of granting and making leasses in person given unto her by act of p’liament by the advice of her counsell hath given granted demised and terme lette unto the said Sir Jerome Horsey knight his executors and assignes th’ofe the said woods and underwoods and all those the said woody groundscalled and knowne by the name or names of Stocking conteyning by estimacon three score ecres be yt more or less lying growing and being in the said Mannor of Princes Risborough principis in the said countye of Bucks EXCEPTED and alwayes referred unto the said most excellent Princess Anne Queene Anne and her assignes during her natural lieff and after her decease unto the King ma’tie his heires and successors all and all manner of great trees with more timber or reputed for timber and all trees and fayre saplings of ? and fit to be or to be made tymber and sufficient ? ? ? ? ? to the terme of the statute in that case ? sett forwith and provided TO HAVE and to hold the aforesaid woods called Stockings ? and ? ? what form (except before excepted) unto the said Sir Jerome Horsey his executors and assignes from and after the end expiracon surrender other determinacon whatsoever of the estate pymittted by the aforesaid recited l’res pattents unto the end and terme and for the and during the whole terme of twenty and one yeres from next ? and fully to be complete and ended YEALDINGE and paying therefore yerely unto the said most excellent Princess Queene Anne and her assignes during her naturall life and after her decease unto the King Ma’tie his heires and successors the sume of three pounds foretene shillings eight pence of lawfull money of England all the ? most shall feast or termes in the yere that is to say all the feasts of St Michaell and the Anuciacon of the blessed Lady Mary the virgin by even and equal porcons to be paid during the said terme the first payment thereof to be made all that of the said feast ? shall first come next after the end and determinacon of the estate lymited by the recited l’res pattents made by the said Henry Best aforesaid and the said rent to be paid duringe her said Ma’ties lief unto her Ma’ties decease of the said County of Bucks for the tyme being and after her highnes unto the ? of the King Ma’tie his heires and successors of the said Countuy of Bucks for the tyme being as in and by the said recited Indenture bearing date the said seavententh day of November among divers other ? agreaments therein conteynes more at large also yet doth and may apeare ALONE THIS INDENTURE further witnesseth that the said Sir Jerome Horsey knight for and in consideracon of the sume of six hundred pounds of lawfull money of England to him att the ensealinge and deliverie of ? by the aforesaid Edward Thomasson well and trulie paied whereof and wherewith the said Sir Jerome Horsey acknowledgeth him self fully satisfied contented and paied and thereof and ? p’te and p’cell thereof doth clerelie release acquite discharge the said Edward Thomasson his heires executors administrators and assignes and enie of them forever by their p’nts HATH granted baragyned sold alyen assigne and lett unto the said Edward Thomasson all the right estate and estates title for all interest and interests ? all lease and leases for all terme and termes of to come percon and percons clayme and demand whatsoever with he the said Sir Jerome Horsey nowe hath may might should or of right ought to have of in and is to the said woods underwoods woodgrounds and other p’misses with theire app’tences and of the ? all conveyances thereupon made and of  the said recited indenture made by the said most excellent Princess Queene Anne to the said Sir Jerome Horsey as aforesaid and of ev’ye or any of them or otherwise by any right maye or meante whatsoever togeather with the said indenture of lease made by the said most excellent Princess Anne to the said Sir Jerome Horsey aforesaid and all other indentures deeds and writings with the said Sir Jerome Horsey hath or ought to have touching or concerning the p’misses or any p’te thereof  TO HAVE and to hold the said woods underwoods woodgrounds and other the p’misses with the app’tennces and all the estate right title interest terme and termes of yeres clayme and demand whatsoever of him the said Sir Jerome Horsey of in and to the p’misses and enie p’te thereof togeather with the said indentures deeds writings aforesaid (except as in the said l’res pattent made to the said Henry Best and in the said indenture of lease made to the said Sir Jerome Horsey gent excepted) unto the said Edward Thomasson his executors administrators assignes fromhensfourth unto the full end and expiracon of the said all termes of thirty and one yeres and twenty and one yeres for all it made and granted by our said late Sovraigne Ladye Queene Elizabeth and the said most excellent Princess Queene Anne to the said Henry Best and the said Sir Jerome Horsey knight finallie as aforesaid AND THE SAID Sir Jerome Horsey knight for himself his executors adminstrators assignes and enye of them doth comemit promise and grant to and with the said Edward Thomasson his executors adminstrators and assignes and to enye of them by their p’nts that he the saidn Sir Jerome Horsey the daye of the makinge sealinge and ? of their p’nts for ? ? the said Sir Jerome Horsey is carefullie ? of all the before mentioned premisses (except before excepted) for and during all the ? all termes of yeres with remaining unexpired conteyned  in the said l’res pattents and indentures of lease made and grannted to the said Henry Best and Sir Jerome Horsey aforesaid and in the rents reservacon comemitment and agreament in the same l’res pattents and indenture of lease formallie conteyned and expressed and that notwith standing any act done or suffered by the said Sir Jerome Horsey he the same Sir Jerome Horsey nowe hath good rightfull and absolute power and authoritye to grant sell bargayne sell alyen assigne and sett over the premisses in ? and forme aforesaid AND FURTHER the said Sir Jerome Horsey knight for himself his heires executors administrators and assignes and enie of them doth comemit promise and grant to and both the Edward Thomasson his executors administrators assignes and to and with enie of them by their p’nts that he the said Edward Thomasson his executors administrators and assignes and enie of them shall or may from tyme to tyme and at all tymes hereafter during the said sev’all termes of thirtye and one yeres and twenty and one yeres yet to come and unexpired in and by the said l’res pattents and indenture of the lease sev’allie made and granted to the said Henry Best and Sir Jerome Horsey as aforesaid peacably and quietlye have hold ocupye possesse and enjoy the said woods underwoods woodgrounds and all and singular other premisses with the app’tennces and enie p’te and p’cell of the same (except before exception) without any manner of ? disturbance interupcon or eviccon of the said Sir Jerome Horsey his executors administrators or assignes of them or any other p’son or p’sons lawfullie clayminge by from or under him or them or any of them clerelie discharged of  and from all forme bargaynes sales gifts grants leases surrendered for ? ? of rent charge titles troubles and ? ? whatsoever had made committed growne or done or ? to be done by the said Sir Jerome Horsey before the ensealing and ? of their p’nts except the sev’all rent covenant and agreement finally referred menconed and comprised by the said l’res pattents and indenture of lease formallie made and granted to the said Henry Best and Sir Jerome Horsey as aforesaid hereafter on the leasees ? to ? due to be paid done and p’formed  AND THE SAID Edward Thomasson comemitment and agreament finally referred menconed and comprised by and in the said l’res pattents and indenture of lease finallie made and granted to the said Henry Best and Sir Jerome Horsey as aforesaid as hereafter ? due to be comemitment and agreament for and in respect onlye of the said woods underwoods and woodgrounds before menconed and of and from all ? such cost damage attachment seazures and demands upon or by reason of the same rents reservacons ? ? condicons ? and agreaments or any of them for any ? hence there to be had or to growe INWITNES whereof of the p’ties aforesaid to their p’nte indentures interchanges ? have sett theire hands and sealed ? the day and yere forth above written 1616

  2. However, it is possible to identify the important information in the document.
  3. The purpose of the Indenture is for Edward Thomasson to purchase the lease for Stockings woods in Princes Risborough from Sir Jerome Horsey for £300.00.
  4. The size of the woods is 60 Acres
  5. The length of the lease appears to be based on earlier leases and is difficult to identify.
  6. Stockings – the name of many woods and is relative to tree density. It is believed that the Parish of Princes Risborough had several Stockings woods but it is possible that these woods were in Lacey Green.
  7. The transcription contains many strange spellings – too many to list – but most can be understood when read in context.
  8. There are also a number of words that I cannot decipher.
